Defendant was charged with two counts of possession controlled drugs of class A and class B with intent to supply, contrary to section 5(3) of the Misuse of Drugs Act 1971. Defendant pleaded guilty and was sentenced to 45 months in prison. Defendant was subsequently made subject of confiscation proceedings under the Proceeds of Crime Act 2002. The Crown calculated the Defendant’s Benefit to be c.£83k and the Available Amount to be c.£51k. The Available Amount comprised assets that the Crown had already seized from the Defendant at the time of arrest, including cash, designer jewellery (Cartier & Rolex) and boxed Nike trainers. We were asked to analyse the Defendant’s bank account and to assess the Crown’s calculation of Benefit.
