A franchisee claimed that the sales information pack supplied by the fast food franchisor was misleading in terms of the profit potential. On the basis of the sales information pack the franchisee signed the franchise agreement. The franchisee operated the franchise for c. 3 years and during this time made losses and the franchisee was forced to sell certain assets to release cash to support the business. A report was prepared on the losses suffered by the franchisee (c. £1m) and also covered lost profit from not operating another business. The case settled prior to the trial.
